Passage conditions

The Booking Conditions and Passage Conditions contained in the P&O Cruises World Voyages January – April 2010 (issued December 2008) are the Conditions on which you book and travel on any P&O Cruises product we sell you. Please read them carefully as you will be bound by them. P&O Cruises/We/Our means Carnival plc.

P&O Cruises acts as an agent for other brands within the Carnival Group in selling you its products. In entering into this contract you are contracting with Carnival plc trading as P&O Cruises. These terms and conditions must be read having regard to the provisions of the Trade Practices Act 1974 (to the extent applicable) which gives rights and remedies to consumers in relation to the supply of goods and services. The terms and conditions in these 'Passage Conditions' do not have the effect of excluding, restricting or modifying any applicable rights under the Trade Practices Act.

  1. No agreement exists between you and P&O Cruises until we have received your deposit monies.
  2. We reserve the right, if we think it necessary, to deviate from the ship's advertised route, to delay or cancel part of, or the whole cruise, to substitute or change the ship or ports of call, to remove the ship from service, to charter out the ship, or to tow or assist any vessel or perform any similar act, in our absolute discretion or that of the Captain. In such an event P&O Cruises shall not be required to refund any portion of the fare, make any other compensation or be liable for any other consequential damage, loss, expense, loss of time or inconvenience. Accordingly, you should not make any important arrangements or meetings based on the proposed itinerary of the cruise, which may change without liability to P&O Cruises.
  3. Cancellations, for whatever reason, will be subject to the following charges: prior to 91 days of sailing, forfeiture of your deposit; between 90 and 61 days of sailing, 25% of the total fare; between 60 and 31 days of sailing, 50% of the total fare; less than 30 days notice or non-appearance at time of sailing, 100% of total fare. Additional handling/service fees may be imposed by your travel agent. Please note that the transfer of an existing cruise booking to a new cruise is regarded as a cancellation of the first cruise booking and is subject to the applicable cancellation fees.
  4. We may not be required to refund any portion of your fare nor pay any expenses whatsoever including any transportation, medical or living expenses if you leave the cruise early, and any such expense which is reasonably incurred by us on your behalf shall be payable by you to us on demand.
  5. We have the right to change the fare applicable before or on the date of departure. Any difference must be paid before you board the ship or commence the cruise.
  6. It may be necessary for us or people working for us or port/government agencies to search you and/or your luggage and goods. You must agree to allow such searches. P&O Cruises reserves the right to deny boarding or to disembark any persons in possession of illicit substances. 
    • The Captain, at all times, has the right to confine, have sedated or to put ashore any passenger whose conduct seriously inconveniences or jeopardises the enjoyment, health or safety of any passenger or other persons. P&O Cruises shall not be liable for such actions or for any loss incurred (including repatriation expenses) and refunds are not payable. Any expense incurred by us under this clause shall be payable by you to us on demand.
    • You consent to P&O Cruises receiving any medical information and documentation resulting from you consulting the on board Medical Department, and to P&O Cruises disclosing these internally as well as to external advisors and insurers.
    • At the time of paying your deposit, it is strongly recommended that you obtain valid comprehensive international travel insurance covering you for the duration of the cruise. You agree to provide proof of this insurance to P&O Cruises if requested. You should carry a copy of the policy with you on your cruise holiday.
    • You consent to P&O Cruises monitoring all public areas of the ship by CCTV and the viewing, recording, retention and utilisation of such recordings by P&O Cruises' ship and shore based personnel and/or P&O Cruises' external advisors. P&O Cruises shall not be liable for any consequences of the viewing, recording, retention and/or utilisation of such recordings or for any loss or damage howsoever arising as a result.
  7. Subject always to our right to limit liability under applicable law or convention:
    • We shall not be liable for the death, injury or sickness of any passenger however arising and whether or not arising in the course of performance of the cruise, unless caused by our proven negligence in which case our liability is limited to AUD200,000.
    • Where the Trade Practices Act 1974 applies and it is not possible to exclude, restrict or modify any conditions, warranties or other rights implied into this contract, P&O Cruises' liability for any breach of condition, warranty or other right is limited to supplying the relevant cruise again or the cash equivalent.
    • We shall not be liable for the loss of or damage to any luggage or goods, including valuables, however arising, unless caused by our proven negligence, in which case our liability is limited to AUD1,500.
    • Any compensation payable by us up to the limits referred to in (i) (ii) and (iii) above will be reduced in proportion to any contributory negligence by you.
  8. Luggage shall be deemed to have been delivered undamaged to you unless written notice of any loss or damage is given to us within 7 days from the date you leave the ship.
  9. Except where it operates as a carrier, P&O Cruises acts only as an agent for bus companies, car hire companies, hotels, shore tour operators and boat or dive operators. Accordingly, we shall not be liable in connection with any of these principals' services. Nor shall we be responsible for information supplied concerning any of those principals' services. Our responsibility does not extend beyond the ship. Whenever you leave the ship, any arrangements made by or for you are at your own risk.
  10. Any action, claim, suit or proceeding arising out of or connected in any way with this contract or the cruise shall only be brought in New South Wales and shall be governed by New South Wales law as shall this contract. Subject to clause 9 any claim must be notified in writing to P&O Cruises within 28 days of you leaving the ship or the date you first had knowledge of the material facts giving rise to your claim, whichever first occurs. Any action, claim, suit or proceeding must be commenced within one year of you leaving the ship or of the date when you first had knowledge of the material facts giving rise to your claim, whichever first occurs. If either of these conditions is not complied with, any action, claim, suit or proceeding and all rights whatsoever and howsoever shall be absolutely barred and extinguished.
  11. You agree that in entering into this contract P&O Cruises is acting as agent or trustee on behalf of the ship, its owners, its operators, the Captain, crew, any staff or agents of P&O Cruises, any charterer of the ship and any substitute ship, its owners, its operators, its Captain and crew and that all such entities and persons shall have the benefit of all rights and exemptions contained in these Passage Conditions. You undertake not to make any claim against any person or entity other than P&O Cruises and if such claim should nevertheless be made, you agree to indemnify P&O Cruises and the person or entity against whom such claim is made against the consequences thereof.
  12. In the event of any inconsistency between these Passage Conditions and the Booking Conditions, and any other terms whether printed or contained in an electronic format, or displayed on any internet website, these Passage Conditions and the Booking Conditions shall exclusively apply.

Booking conditions

  • GENERAL: All bookings are subject to these Booking Conditions, and the Passage Conditions contained in this brochure, and to the availability of the appropriate accommodation at time of booking. Some cruise sectors may be capacity controlled and waitlisted at time of booking. We reserve the right to change the cabin allocated to you at any time at our discretion.
  • GUARANTEES: A guarantee is P&O Cruises' undertaking to provide a specific type of cabin and fare, so passengers can proceed with their cruise plans. A cabin number however, will be advised at a later date. P&O Cruises reserve the right to change the cabin allocated to you at any time, at our discretion.
  • CONFIRMATION, PAYMENT, MANDATORY BOOKING FORM AND DOCUMENTATION: For the booking to be confirmed the deposit of 10% of your fare (minimum $400.00) must be received in our office and applied to the booking (advice of payment not accepted) within three days of making the booking or it will be automatically cancelled. A signed and fully-completed booking form, which can be completed online at pocruises.com.au or as enclosed in this brochure, must also be submitted at this time. The new online booking form is easy to use, simply go to pocruises.com.au, then click on the Cruise Personaliser section, read and accept our Terms and Conditions, then enter your booking number and name as per the booking. The balance of fares must be paid no later than 90 days prior to sailing. We cannot accept Pounds Sterling for payment. Documentation will be dispatched approximately 2-3 weeks prior to sailing. Cruise documents will not be released if payment and a signed and fully completed booking form have not been received.
  • CANCELLATIONS: Cancellations made before the advertised date of departure will incur the following charges per person prior to 91 days, forfeiture of deposit; between 90-61 days prior to sailing, 25% of total fare; 60-31 days prior to sailing, 50% of total fare; less than 30 days, 100% of total fare. In addition, your travel agent may choose to charge you a handling fee. Cancellation charges do not apply to the Passenger Movement Charge, if applicable, which is fully refundable at time of cancellation. Please note that the transfer of an existing cruise booking to a new cruise is regarded as a cancellation of the first cruise booking and is subject to the applicable cancellation fees. Cancellation notice must be received in writing, email or by fax to The Company (for details see reverse). It should be marked to the attention of the Reservations Department.
  • CHANGES TO RESERVATIONS: Any changes of bookings to other grades of accommodation or sectors, regardless of booking status, or any alterations to, or cancellations after deposit, will incur an administration charge of AUD220 per person and are subject to availability. P&O Cruises reserves the right not to accept replacement passengers for bookings in any grade of accommodation for which there is a waitlist on that particular cruise. Replacement passengers are only permitted outside of 75 days of departure in the instance where a complete cabin is booked and one person in that cabin cannot travel, and are subject to approval. In this instance, a replacement passenger will be accepted or remaining passengers will be charged the applicable fare (see 'FARE BASIS'). An administration fee of AUD100 per person will apply for each replacement passenger accepted after deposit has been received. Please note that replacement passengers are not permitted inside 75 day of departure. It is essential that your full passport name is given to P&O Cruises at the time of booking, as any correction/alteration to a passenger name after tickets/vouchers have been issued is subject to an AUD55 per person charge on each occasion.
  • HEALTH: Passengers' wellbeing is our foremost concern. Any recent/current physical or mental condition that may require medical attention or special treatment (including travelling with a wheelchair), must be advised to us at time of booking and confirmed in writing with your deposit. If you are travelling with any medical apparatus, please advise us in writing at time of booking so we can ensure this apparatus will operate on board. A booking may be refused or cancelled after deposit for anyone whose state of physical or mental health renders them, in the opinion of the Company, unfit for travel, or anyone whose condition may constitute a danger to themselves or any other passenger. Details regarding wheelchair access are available on application. Your travel agent should check with P&O Cruises for details. A certificate of fitness to travel is required from all passengers with a medical condition, including documentation of your recent medical history. This is required with your booking form and deposit. Passengers must also bring sufficient quantities of any prescribed medicines to last the duration of the cruise. If your health condition as declared at the time of booking changes, you must inform P&O Cruises immediately on 13 24 28. If, in our opinion, you have failed to inform us of any condition which we consider potentially damaging either to yourself or any other passenger, we shall refuse boarding.
  • MOBILITY: Passengers who are not fully mobile and use wheelchairs are very welcome aboard our ships, but you must let us know when making your booking, as we can only accept a limited number of wheelchairs on each cruise. If you do use a wheelchair or expect to use one during any part of your cruise you must provide your own standard size wheelchair (access is limited for larger wheelchairs) and you must travel with a companion fit and able to assist you. There are cabins which are accessible for those who use a standard size wheelchair – please ask us for details.
  • VACCINATION AND HEALTH ADVISORIES: We recommend seasonal influenza vaccination for all passengers. Furthermore, you are strongly advised to seek advice from either your doctor or an approved public health travel advisory service, to identify any specific vaccination or health precautions required for each port of call, e.g. World Health Organisation (www.who.int/ith) or The Australian Department of Foreign Affairs and Trade (www.dfat.gov.au). Some countries strictly enforce certain health requirements. Failure to comply may result in the local authorities preventing passengers from going ashore and some may impose a monetary fine or deny the ship entry into the port.
  • PASSENGERS WITH DISABILITIES OR REQUIRING ASSISTANCE: P&O Cruises has other facilities available for people with disabilities or who require assistance. Please ask your travel agent or P&O Cruises if you have any special needs.
  • MEDICAL SERVICES: The on board medical centre is staffed by full time British registered doctors and nurses. In addition to regular centre opening hours, medical staff are on call 24 hours a day, seven days a week to provide medical care for both passengers and crew in the event of an emergency. Charges apply for consultations, treatments and medication, and are in Pounds Sterling. These charges will be added to your on board account, and you will receive an itemised account to submit to your insurance company. It is essential that you have adequate health and travel insurance to cover any eventuality. We strongly recommend that you arrange appropriate international travel insurance at time of booking.
    P&O Cruises is not a healthcare provider and shall not be liable for the death, injury or sickness of any passenger arising from any act or omission of doctors, nurses or other providers of medical services with respect to the treatment, advice, care or services of any kind given by such persons to any passenger. These medical providers exercise their own medical judgment and expertise.
  • DINING: Seating arrangements in the dining rooms are made by request on a first-come, first-served basis. To request your preference for first or second sitting, special diets, or seating with a specific party, it is best to have your travel agent make the request at the time of booking. Please note that dining requests may be subject to change.
  • CHILDREN: Passengers under the age of 18 years must travel with a parent or companion over the age of 21 years, and we are unable to carry babies aged 12 months or under for any voyage published in this brochure. Please note that Arcadia is dedicated to adults only and therefore we do not accept children or teenagers under the age of 18.
  • PREGNANCY: P&O Cruises cannot accept any passenger who will have entered the 24th week of pregnancy at any stage during the cruise.
  • ILLICIT SUBSTANCES: P&O Cruises reserves the right to search your person and/or luggage for any illicit substances. P&O Cruises reserves the right to deny boarding or to disembark any persons in possession of illicit substances.
    SMOKING: In the interests of passenger comfort, certain sections of the ship are designated as 'Non-Smoking', including all dining areas. We kindly ask you not to smoke in these areas.
  • TRAVEL INSURANCE RECOMMENDED: At time of deposit, it is essential that you take out comprehensive international travel insurance to cover any eventuality, including any pre-existing medical conditions and charges arising should you have to cancel your holiday plans. P&O Cruises may not be liable for lost or damaged baggage and personal property. Arrange a policy with your travel agent or P&O Cruises when booking, and carry a copy of the policy with you on your cruise holiday.
    PASSPORTS: Passports are required on all cruises and should have at least 6 months validity after your return date to your country of residence.
    VISAS: It is the sole responsibility of the passenger to obtain visas required for their travel arrangements. Please check with P&O Cruises or your travel agent at least 3 months prior to departure for any visa requirements to cover the ports of call on your itinerary. This will depend on individual passport details. Passengers who do not possess the proper documentation required for their travel arrangements will be prevented from boarding the ship without refund.
  • LUGGAGE: You can bring as many bags as you can comfortably fit into your cabin, but please restrict the weight of each item to no more than 30 kg for handling purposes.
  • FARE BASIS: Brochure fares and other prices shown in this brochure are quoted in Australian dollars (unless stated otherwise) and are per adult based on double occupancy (except single cabins). Your 'total fare' includes the cruise fare, discounts, charges, government taxes (including the Passenger Movement Charge, where applicable), which are correct at time of publication, but are subject to change without notice. The discount of up to 50% is available on cruises booked and deposited and is subject to limited availability. P&O Cruises has set aside cabins at selected grades that are available at up to 50% discount. Once these cabins are sold, the fare may revert to an alternative discount rate or the full brochure fare, and the on board credit may be withdrawn. P&O Cruises reserves the right to do this at any time. All other information in this brochure, including itinerary details are subject to change without notice. No refunds are available when changes do occur. Your travel agent or P&O Cruises can provide up-to-date advice.
  • On board CREDITS: On board credit applies to all passengers occupying the first two standard beds in a cabin. Non-use of the on board credit cannot be transferred or redeemed for cash. Cruise duration is determined by the number of brochure nights, excluding pre or post touring options. On board credit is subject to limited availability, and may be withdrawn at any time, at P&O Cruises' discretion.
  • YOUR FARE INCLUDES: Your cruise fare includes accommodation, all main meals (however, a small cover charge applies at some Select Dining venues on board), entertainment, and most normal shipboard services and facilities while on board, and all government taxes and charges including all port taxes.
  • YOUR FARE DOES NOT INCLUDE: Domestic or international air travel; transfers between domestic and international airport terminals; hotel accommodation; shore excursions; drinks; tips; meals ashore; passport/ visa fees; travel insurance; vaccination costs; items of a personal nature; food and cover charges at the Select Dining venues as indicated on board; room service menu items; hairdressing services; massage and beauty treatments; photographic services; merchandise from on board shops; some materials for selected optional activities and entertainment such as handicrafts and bingo; telephone calls, faxes, internet access (where applicable) and emails from the cyb@study; all costs for medicines and treatments in the ship's medical centre; laundry and dry cleaning services.
  • EXCHANGE RATES: We reserve the right to increase fare prices to take into account exchange rate fluctuations.
  • CURRENCY On board: All prices and charges on board Arcadia and Aurora in this brochure are in Pounds Sterling. We accept all major credit cards (Visa, MasterCard, American Express, Diners Club and Delta/Debit cards), cash and travellers cheques. Travellers cheques can only be accepted on board, they are not accepted as payment for a cruise booking
  • GRATUITIES On board: During your cruise, many members of our on board staff will provide you with excellent service, and tipping is simply the traditional way of saying 'Thank You'. Although tipping is voluntary, and at passengers' discretion, we are frequently asked by passengers to recommend an appropriate daily amount, and we suggest £3.75 per passenger per day. Staff at the Purser's Information Desk will be delighted to assist passengers in relation to any queries they may have about their tipping amount.
  • IMPORTANT INFORMATION: While all the information in this brochure is correct at the time of publication, some details could possibly change. Ask your travel agent to check at time of booking or call P&O Cruises. Some photos shown in this brochure are representative only. Privacy policy: Upon completion of your cruise, your booking information is automatically transferred to our past passenger database to ensure that you are notified of special offers that are regularly made available to our past passengers. If you do not wish to receive such offers, please contact P&O Cruises in Australia on 13 24 28 or in New Zealand on 0800 95 12 00. We respect your privacy and the personal information you provide to us will be treated in accordance with our privacy policy.
